Draft Local Provisions Schedule Consultation

DRAFT TASMAN LOCAL PROVISIONS SCHEDULE 

The Tasmanian Planning Scheme (TPS) will apply across the whole State. It will replace the current planning schemes that operate in each Council area.

The TPS is made up of the State Planning Provisions (SPP’s) and a Local Provisions Schedule (LPS) for each council area.  The SPP’s have been approved by the Minister for Planning.

The Tasman draft LPS was exhibited from 11 January 2021 to 15 March 2021.  Exhibition documents are provided below.

At its June meeting, Council acting as the Planning Authority consider each representation received.  The associated report can be viewed in the Council agenda and minutes section of the report and is provided below under ‘exhibition documents’.  The associated s35G report is provided at the end of this page.

STATE PLANNING PROVISIONS 

The SPP’s were made by the Minister in February 2017, with minor amendments subsequently.

The SPP’s set out the way the planning scheme operates, the zones that can be applied to land and the planning rules for use and development that occurs within those zones. The SPP’s also include planning rules in codes, relating to matters that occur across various zones. The intent of the TPS is to achieve as much consistency as possible in the planning rules that apply across the State.

TRANSITIONAL PROVISIONS 

The Tasman draft LPS includes some specific area plans, site specific qualifications and code applying provisions that are currently operating in the Tasman Interim Planning Scheme 2015. These provisions have been approved by the Minister for Planning to transition into the Tasman draft LPS under Schedule 6 of the Act.

The draft LPS references ‘Australian Standard AS 1537-2012-On-Site Domestic Wastewater Management’ as an Applied, Adopted or Incorporated Document. This is a licensed document and payment is required to view and download the document on the SAI Global website.  You can view a hard copy of the Australian Standard at the Council or Commission offices.
